Rotorua Gang Member's Sentence Upheld Despite Paraplegic Victim

A Rotorua gang member, Raymond Heta, has lost his appeal to reduce a seven-year-and-three-month jail sentence for his role in a brutal home invasion that left a victim permanently paraplegic. The Court of Appeal ruled that the sentence was not manifestly excessive, despite the severe and lifelong consequences suffered by the victim.

The incident took place in May 2022 when Heta and four other men, some wearing gang patches and all in disguise, attacked the victim in his home. The assault involved punches, kicks, and a stab wound that resulted in a spinal cord injury at the T10 vertebra level. This injury has left the victim paraplegic, with lifelong detrimental consequences.

During the attack, the gang members also stole the victim's wallet and cellphone. Heta was charged with aggravated robbery and unlawfully taking a motor vehicle. He pleaded guilty following the victim's testimony against him in court.

Heta's legal team had argued that his deprived childhood and history of criminal behavior should result in a reduced sentence. However, the Court of Appeal determined that Heta's continued violent behavior into his middle years meant that accountability and the protection of the community were of greater importance than mitigating factors.

One of the co-defendants received a five-year sentence, while the identities of the other three individuals remain unknown. The court's decision has been widely seen as a strong message to deter similar violent crimes and to reinforce the principle that those who commit serious offenses must face the full weight of the law.
