Cafe Owner Sentenced to 11 Months of Home Detention for Inappropriate Behavior Toward Employees

A 35-year-old cafe owner in Katikati has been sentenced to 11 months of home detention for indecently assaulting multiple young female staff members. The court found him guilty of 12 charges of indecent assault and two charges of indecent assault on a young person. The judge emphasized that the accused's behavior went 'beyond flirtatious or tactile' and that he must have known his actions were inappropriate.


According to the court, the accused engaged in a range of inappropriate behaviors, including grabbing the shoulders, hips, and buttocks of his employees, making inappropriate comments, and sending explicit messages to one of the victims after a work party. The judge noted that these actions were not isolated incidents but part of a 'deliberate pattern of behavior towards young and vulnerable females.'


The court also highlighted the grooming behavior in the accused's messaging and the significant impact on the victims' trust and ability to move on to new employment. The judge ruled that the accused's conduct was in stark contrast to how he treated older female employees, suggesting a clear double standard in his behavior.


Van Loon was initially sentenced to 22 months in prison but received a reduced sentence of home detention due to his limited financial means. The judge did not require him to make reparations for emotional harm, stating that such a requirement would have been 'insulting' to the victims.
