A 70-year-old security guard mistakenly kills his mentally ill daughter; judge calls it a tragedy and sentences him to 4 years and 8 months in prison
A 70-year-old security guard, Chan Kui Shing, killed his daughter who suffered from multiple mental illnesses after enduring prolonged abuse from her. In the end, he could no longer bear it and strangled her to death. After the trial, he was found guilty of manslaughter. Judge Hu Yat Man stated during sentencing that the case was a tragedy for all parties involved. Considering the level of anger the defendant experienced, she believed his reaction was not disproportionate, and ultimately sentenced the defendant to 4 years and 8 months in prison.
The defendant lived with his ex-wife and daughter in Wong Tai Sin's Hai Fu苑. His daughter was diagnosed with autism, obsessive-compulsive disorder, learning disabilities, and Asperger's syndrome after losing her job in 2016. On the day of the incident, the defendant was prevented from using the toilet by his daughter, and was attacked with an umbrella and scolded for two hours. After thinking for an hour, he decided to kill his daughter. After killing his daughter, the defendant immediately sent a message to his wife and called the police to surrender.
The prosecution stated that the defendant's family of three had long had disputes over trivial matters such as cleaning and washing dishes, and had multiple physical altercations. The police had also responded to the scene multiple times. The defendant's ex-wife said she had repeatedly sought help from relevant departments to arrange accommodation for her daughter, but no results had been achieved. The defendant's daughter's younger sister also stated in court that the deceased's mental condition had deteriorated since losing her job, and she often argued with her family, even physically and verbally abusing her parents.
A psychiatrist stated that the defendant had moderate adjustment disorder at the time of the incident, with causes including the pandemic, living with his ex-wife, and being physically and verbally abused by his daughter. The judge ultimately believed that although the defendant's actions were illegal, due to the special circumstances, she could show leniency and sentenced him to 4 years and 8 months in prison.
