TSMC 2nm Technology Leak Case, National Science and Technology Council: Maximum 12-Year Criminal Liability

TSMC has revealed that an engineer is suspected of stealing 2nm process technology secrets. The National Science and Technology Council stated that if national core critical technology trade secrets are stolen, the investigation will be handled by the prosecutors and the criminal liability will be increased, with a maximum of 12 years in prison and a fine of 100 million New Taiwan dollars. The Intellectual Property Division of the High Prosecutors' Office pointed out that a former TSMC employee, Mr. Chen, and an in-service employee, Mr. Wu, along with others, are suspected of illegally obtaining trade secrets. In July, an investigation was launched, and the court approved the application for the detention and prohibition of contact with Mr. Chen and two others based on violations of the National Security Law. TSMC stated that it has imposed strict disciplinary actions on the involved personnel who violated the rules and taken relevant legal actions. The National Science and Technology Council further explained that the National Security Law has clearly defined economic espionage as a crime to prevent the possibility of illegal leakage and avoid damage to the country and industrial interests.
